The Legal Assistance Scheme has been reviewed by the Association and a booklet detailing the revised terms of the Scheme has issued to each member.
A member shall first consult with his/her Central Executive Committee representative who will advise him/her of the procedure when making an application for legal assistance. The Central Executive Committee member shall be provided with all of the information and correspondence in relation to the claim. The Central Executive Committee member will in turn make a submission to the Association through the Legal Assistance Sub Committee in accordance with the procedure outlined at Section 7 of the booklet.
All applications for legal assistance, with the exception of urgent applications, shall be processed through the Legal Assistance Sub Committee. In the event of an emergency case requiring immediate legal intervention such case shall be processed through the Central Executive Committee member and must have the approval of a member of the secretariat.
The Central Executive Committee is the final arbiter on all matters relating to the Legal Assistance Scheme. Notwithstanding the Association’s approved panel of Solicitors, the Association accepts that all members should be allowed to choose their own Solicitor for dealing with District Court cases, sworn inquiries and cases before the Garda Siochana Ombudsman Commission in accordance with the Association’s scale of fees as set out at Nos. 8 and 9 of the booklet .However, if it is necessary to proceed to a Higher Court, then the case will be referred to one of the Association’s panel of Solicitors selected by the member concerned and, where the member has no preference, the choice will be made by the Legal Assistance Sub Committee or, in a matter of urgency, by the secretariat.
